NLLC – Landscaping and Lawn Care Services – Contract Terms and Conditions.

  1. Deviation from Agreed Specifications:Any deviation from agreed specifications and/or terms shall be by mutual agreement and shall be in writing. Payment for extra work and allowances for omissions shall be fixed in advance on demand by either party and shall be set forth in writing.
  2. Insurance Coverage: The contractor will carry worker’s compensation insurance covering its employees and shall provide adequate public liability and property damage insurance protecting itself.
  3. Ownership of Materials:  All material remains the property of the contractor until full payment has been received for job completion.
  4. Termination and Compensation: If the customer chooses to terminate the contract or abandon the project in any state of its development, the contractor shall be entitled to just and equitable compensation for all services performed on the customer’s behalf up to the time of such notification.
  5. Ownership of Drawings and Specifications(if applicable): All drawings and specifications remain the property of the contractor until the account is paid in full.
  6. Quotation Validity: Quotations are valid for thirty (30) days.
  7. Contingencies: This agreement is contingent upon weather, Acts of God, product availability, strikes, accidents or delays beyond our control.
  8. Responsibility of Property Lines and Utilities: The client/owner will be responsible for location/stake out of all property lines, underground wiring and piping (e.g., cable, TV, gas, telephone, hydro, water, irrigation, lighting, etc.).
  9. Contractor’s Non-Responsibility: The contractor will not be responsible for claims or damages arising from the owner’s failure to properly locate property lines and/or utilities and other underground services.
  10. Damage to Existing Systems: In any garden renovation, some damage to existing irrigation and/or garden lighting systems may occur. Contractor cannot be held responsible for any damages incurred.
  11. Unforeseen Circumstances: The contractor shall not be responsible for any unforeseen circumstances which may result in damage to the landscape (e.g., vandalism, Acts of God, etc.).
  12. Obstruction Removal: The owner shall be responsible at cost for the removal of any obstruction which occurs during excavation, including buried rocks, stumps, foundations, etc.
  13. Guarantee for Hard Landscaping: All hard landscaping is guaranteed for one (1) year against defects in workmanship and materials from the time of completion.
  14. Guarantee for Plant Material: Plant material supplied by the contractor is guaranteed for one (1) year from the time of acceptance provided that proper maintenance and protection have been performed.
  15. Use of De-icing Salt: The use of de-icing salt (calcium chloride) on walkways will void guarantees. Use of alternative de-icing products is recommended.
  16. Owner’s Responsibility During Guarantee Period:During the guarantee period, the owner is responsible for the prevention of any damage to the landscaping.
  17. Payment Schedule & Terms:
      • Residential:
        • 25% on signing of contract
        • 25% on commencement Project
        • 50% on completion
      • Commercial: Payment terms to be arranged with contractor.
        • These terms and conditions outline the contractual agreement between the client and the landscaping contractor. It is important to read and understand these terms before proceeding with the project.

NLLC Snow Removal – Terms and Conditions

  1. Commencement of Service: After a snowfall of 4 centimeters or more, snow clearing activities will commence. Follow-up visits will be performed after city plows and sidewalk cleaners have passed. The timing of service visits will vary from storm to storm, depending upon the timing of the snow.
  2. Snow Removal Process: Snowblowing means blowing snow from the described physical area to any permissible area nearby. Removal of drifted snow is the responsibility of the property owner. If inadequate space exists on your property for storage of snow, you agree to allow the Contractor to use space on the side of the driveway or make alternate arrangements for snow storage.
  3. Service Limitations:  No loading or transport of snow, sanding, salting, de-icing, or hand shoveling is included in this contract unless otherwise specified.
  4. Snow Removal Conditions: Snow will only be cleared for accessible areas opening onto the street if vehicles are parked in the driveway. Service will not be provided if children are playing in the area where snow will be blown until children clear the area. Equipment operators will stay at least two (2) feet away from garage doors at all times to avoid damage.
  5. Contract Duration and Snow Limits: The contract term is from November 1st to April 15th of the indicated season or up to a total accumulation of 250 centimeters of snow. A surcharge of $0.75/cm will apply for amounts of snow received in excess of this limit.
  6. Walkway Shoveling and Marker Installation: Walkway shoveling service, if included, is performed separately from driveway clearing. Two (2) driveway markers will be installed at the beginning of every snow removal season. Damaged markers will be replaced at a cost of $10/marker.
  7. Customer Responsibilities: It is your responsibility to keep the snow removal area free of all objects by moving them at least 4 feet from the edge of the service area.
  8. Indemnification: The Contractor shall indemnify and hold harmless the client from any claim for damages arising from bodily injury, death, or property destruction caused by negligence or breach of the agreement by the Contractor.
  9. Payment Terms and Charges: Cheques returned for any reason will incur an administrative fee of $25 per cheque.
  10. Cancellation and Refunds: In the event of default or breach of conditions by either party, the contract may be cancelled, and reimbursements may be provided based on the circumstances.

These terms and conditions outline the contractual agreement between the client and NLLC for snow removal services. It is important to read and understand these terms before engaging in services

Scheduled Policy – Cancellation Policy:

  1. There is no fixed term to the agreement between the customer and NLLC.
  2. Clients may cancel recurring or one-time cleaning services up to 48 hours prior to the scheduled booking.
  3. A late cancellation fee of 50% of the originally scheduled work may apply if notification is received less than 48 hours before the scheduled clean.
  4. NLLC reserves the right to cancel the service provided at any time.
  5. For clients entering into an Annual Maintenance Contract (AMC), the entire amount is non-refundable due to discounted rates offered.

Insurance and Bonding:

  1. All NLLC professionals are bonded and insured to provide professional cleaning services.

Conduct:

  1. Employees of NLLC will maintain a respectful demeanor while on your property.

Pets Escaping from the Property:

  1. NLLC cannot be held responsible for pets that escape when our staff are entering or exiting your property.
  2. If pets will be roaming free during the service, please inform us in advance.

Equipment and Supplies:

  1. NLLC provides its own cleaning supplies and equipment.
  2. Clients may request the use of specific products by contacting our office in advance.

Arrival Time:

  1. While we strive to accommodate AM or PM scheduling preferences, no specific times are guaranteed.

Payment Policy:

  1. Payment in full is due at the time of booking a schedule online
  2. Accepted payment methods include credit cards (Mastercard/Visa).
  3. For cleaning jobs, a 50% advance payment is required upon contract approval.

Scope of Work and Quality Control:

  1. Cleaners will not perform any tasks beyond the agreed scope of work while the contract is approved.
  2. Upon completion of the cleaning, pictures will be sent to the client for review.
  3. The client will have 30 minutes to review the cleaning and respond. If no response is received, the cleaning will be considered perfectly done.
  4. Complaints made after 30 minutes will incur an additional $40 charge for revisiting the site.
  5. Our quality control includes home inspections and client contact to ensure high standards of service.

Additional Charges:

  1. Delivery charges for keys or other utilities such as towels, bedsheets, blankets, etc., will be $40.
  2. If the client requests an on-site inspection by management, an additional fee of $30-40 will be applicable.
  3. Additional charges for garbage removal apply and can be arranged by contacting the management.

Shift Hours and Liability:

  1. The minimum shift hours for a cleaning job are 3 hours, payable upon the cleaner’s entry to the property.
  2. The maximum hours may vary based on the scope of work after surveying the site.
  3. The company holds no liability for work outside its scope.

Key Management:

  1. Clients must ensure their property is accessible to NLLC.
  2. Instructions regarding access should be communicated to our team before the service.

Office Hours:

  1. Our office hours are Monday through Friday, 9:00 am to 5:00 pm.
  2. Voicemails left outside office hours will be returned on the next business day.
